Privacy Policy
1. About this Policy
Fight Academy Australia operated by Fight Gyms Pty Ltd (ABN 33656509812) ("we", "us", "our"), is committed to protecting your privacy. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
This Policy explains what personal information we collect, how we collect, hold, use and disclose it, how you can access or correct it, and how to make a complaint.
2. Scope
This Policy applies to personal information collected by Fight Academy Australia through:
1. our websites and online services;
2. membership, class enrolment and event registration processes;
3. in-person attendance at our academies, events or training sessions;
4. phone, email, SMS, social media or other communications with us; and
5. marketing, recruitment and other business activities.
It does not apply to information that has been de-identified so that it can no longer be linked to an identifiable person.
3. Anonymity and pseudonyms
You can deal with us anonymously or using a pseudonym where it is lawful and practicable, such as for a general enquiry. For memberships, class bookings, payments and training safety, we need to identify you.
4. What we collect
We only collect personal information that is reasonably necessary for our functions and activities. This may include:
1. Identity and contact information: name, date of birth, gender, postal address, email address, phone numbers and emergency contact details.
2. Membership and enrolment information: membership type, class enrolments, attendance records, training history, belt rank and progress notes.
3. Health information: medical conditions, injuries, medical clearances, disability information and dietary requirements where relevant to training safety.
4. Payment and billing information: billing address, transaction history and, if you pay by direct debit, bank account details. Card payments are processed directly by our third-party payment provider. We do not collect or store your credit or debit card details.
5. Communications data: correspondence, feedback, complaints and customer service interactions.
6. Marketing preferences: your consent and preferences for receiving newsletters, promotions and other communications.
7. Recruitment information: resume, employment history, references, right-to-work documentation and, for coaching roles, Working with Children Check details.
8. Technical information: IP address, device identifiers, browser type, operating system, cookies and analytics data from our websites or apps.
9. Images: photos and video from training sessions, events or promotional activities.
Children. Where a child under 18 trains with us, we collect their information from, and with the consent of, their parent or guardian.
Sensitive information. Health information and Working with Children Check details are "sensitive information" under the Privacy Act. We only collect sensitive information with your consent (or a parent or guardian's consent for a child), unless the law permits otherwise, such as in a medical emergency.
5. How we collect personal information
We collect personal information directly from you when you:
1. register for membership, classes or events;
2. book or purchase services;
3. complete forms on our website or at our venues;
4. communicate with us by phone, email, SMS or social media;
5. apply for a job with us; or
6. provide feedback or take part in surveys.
We may also collect information from third parties, such as payment processors, referees, emergency contacts, government agencies, medical practitioners (with your consent) and publicly available sources. Where we do, we will take reasonable steps to let you know.
If we receive personal information we did not ask for and could not have collected ourselves, we will destroy or de-identify it where lawful and reasonable to do so.
We will only take photos or video of you for promotional use with your consent. You can withdraw that consent at any time by contacting us.
6. How we use personal information
We collect, hold and use personal information to:
1. provide and manage memberships, classes, events and services;
2. process payments and refunds;
3. keep you safe and provide appropriate care during training, including responding to medical needs;
4. contact you about bookings, class changes, account matters, incidents and other service matters;
5. send you marketing, where permitted (see section 7);
6. manage recruitment, employment and contractors;
7. handle complaints, disputes and legal matters;
8. improve our services, facilities and website through research and analytics; and
9. comply with our legal and regulatory obligations.
We will only use or disclose your information for another purpose with your consent, or where the Privacy Act permits it.
7. Direct marketing
We will only send you marketing by email or SMS with your consent, in line with the Spam Act 2003 (Cth). Every marketing message includes a simple way to unsubscribe. You can also opt out at any time by contacting us (section 16).
8. Disclosure of personal information
We may disclose personal information to:
1. our staff, coaches and contractors who need it to provide our services;
2. service providers such as payment processors, IT and cloud providers, marketing platforms, mailing houses and analytics providers;
3. medical professionals, emergency services and hospitals where necessary for your safety, or as otherwise permitted by law;
4. law enforcement, regulators, courts or other authorities, as required or authorised by law;
5. prospective buyers or advisers in connection with a sale, merger, restructure or transfer of our business, subject to confidentiality obligations; and
6. other third parties for marketing or promotion, only where you have consented.
We require our service providers to protect personal information and use it only for the services they provide to us. We do not sell your personal information.
9. Overseas disclosure
Some of our service providers, such as cloud hosting, email and payment platforms, may store or process personal information outside Australia. Before disclosing information overseas, we take reasonable steps to ensure the recipient handles it consistently with the APPs.
10. Security and retention
We hold personal information electronically and in hard copy. We protect it with measures such as access controls, secure third-party systems, password protection and staff training.
When we no longer need personal information for any purpose permitted by law, we take reasonable steps to destroy or de-identify it, unless we are required to keep it (for example, for tax or employment records).
11. Data breaches
If a data breach is likely to cause serious harm to anyone affected, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) under the Notifiable Data Breaches scheme.
12. Cookies and analytics
Our website uses cookies and analytics tools, such as e.g. Google Analytics, to understand how the site is used and improve it. You can disable cookies in your browser settings, but some parts of the site may not work properly.
13. Accessing and correcting your information
You can ask to access or correct the personal information we hold about you by contacting us (section 16). We will respond within 30 days. There is no fee to make a request, though we may charge a reasonable fee to cover the cost of providing access.
If we refuse access or correction, we will explain why in writing and tell you how to complain. We may need to verify your identity before acting on a request.
14. Complaints
If you have a privacy complaint, please contact our Privacy Officer in writing (section 16). We will acknowledge your complaint and aim to respond within 30 days.
If you are not satisfied with our response, you can complain to the OAIC at www.oaic.gov.au or on 1300 363 992.
15. Changes to this Policy
We may update this Policy from time to time. The current version will always be on our website, with its effective date shown at the top.
